商標(biāo)權(quán)和外觀設(shè)計專用權(quán)之間相沖突如何處理?

商標(biāo)權(quán)與外觀設(shè)計專利權(quán)都是重要的知識產(chǎn)權(quán)，分別受《商標(biāo)法》和《專利法》的保護。這些權(quán)利的取得，應(yīng)當(dāng)遵守《民法通則》中的誠實信用原則，不得侵害他人的在先權(quán)利。注冊商標(biāo)侵犯了他人在先取得的外觀設(shè)計專利權(quán)的，外觀設(shè)計專利權(quán)人可以請求商標(biāo)評審委員會裁定撤銷該注冊商標(biāo)；外觀設(shè)計專利權(quán)的取得侵犯他人在先注冊的商標(biāo)的，商標(biāo)專利權(quán)人可以通過專利局或者專利復(fù)審委員會，依照撤銷專利或者宣布專利無效的法律程序取消專利權(quán)。
